{"id":3187,"date":"2018-01-12T11:44:45","date_gmt":"2018-01-12T11:44:45","guid":{"rendered":"https:\/\/www.cardonet.co.uk\/news\/?p=3187"},"modified":"2018-06-12T12:16:56","modified_gmt":"2018-06-12T11:16:56","slug":"gdpr-personal-data-more-important-organ-donation","status":"publish","type":"post","link":"https:\/\/cardonet.com\/news\/gdpr-personal-data-more-important-organ-donation\/","title":{"rendered":"Why is my email address more important than my kidneys?"},"content":{"rendered":"<p><strong>When I\u2019m not busy helping Cardonet\u2019s customers with proactive IT support, I study philosophy, and in my philosophy class last week we explored the topic of organ donation. Along with learning about the Victorian\u2019s macabre obsession with death and the origin of the phrase \u201c<a href=\"https:\/\/www.phrases.org.uk\/meanings\/saved-by-the-bell.html\" target=\"_blank\" rel=\"noopener\">saved by the bell<\/a>\u201d, I had another interesting revelation.<\/strong><\/p>\n<p>To my surprise, I noticed that the words and phrases used to describe the process of opting in or out of organ donation looks very much like the wording marketers use when they want you to opt into email lists or newsletters.<\/p>\n<p>We are all now very familiar with phrases like \u201copt in\u201d \u201copt out\u201d \u201cdeemed consent\u201d etc. because of the tidal wave of communications about GDPR (General Data Protection Regulation) but I\u2019m sure that \u2013 like me &#8211; many of you were unaware about the possible changes to organ donation consent.<\/p>\n<p><strong>Proposed change to regulation: deemed consent<\/strong><\/p>\n<p>The House of Commons is at the early stages of considering a bill, which \u2013 if passed &#8211; means that at death all UK citizens will be donors unless they have actively registered their decision to \u2018opt out\u2019.\u00a0This \u2018deemed consent\u2019 system is already in use in Wales.<\/p>\n<p>The purpose of the change is to address the fact that at any one time there are around 6,400 people on the transplant waiting list and <strong><a href=\"https:\/\/www.organdonation.nhs.uk\/supporting-my-decision\/the-opt-out-system\/\">on average three people die each day in the UK in need of an organ transplant<\/a><\/strong>.<\/p>\n<p>Now I want to be clear that I\u2019m not against organ donation and I do not plan on opting out. But I am slightly concerned that I \u2013 my family, my team and my customers \u2013 have all heard an awful lot more about GDPR than we have about the possibility of organ donation in the UK changing from \u201copt in\u201d to \u201cdeemed consent\u201d unless we proactively \u201copt out\u201d.<\/p>\n<p>Essentially, unless we intervene the UK government will have decided for us that we will donate our organs after death. Whereas, once GDPR comes into force at the end of May 2018, we will each wield much more power and choice with our personal data (email address, postal address, ethnicity, political beliefs) as standard.<\/p>\n<p>So why is it I have heard so much more about GDPR? Is my personal data more important than my kidneys or corneas?<\/p>\n<p><strong>Is GDPR just another money-making scheme for cynical businesses?<\/strong><\/p>\n<p>As an IT business owner I understand that there is a need to educate businesses and individuals about cyber security and for data controllers and processers to be more transparent about how they use personal data.<\/p>\n<p>However I can\u2019t help but think at least some (and I\u2019m being generous there) of the \u201cnoise\u201d around GDPR is a cynical attempt to generate revenue out of others\u2019 ignorance. I can\u2019t be alone in noticing the number of data protection experts that have emerged in the last 12 months?<\/p>\n<p>It seems we\u2019ve lost all sense of proportion when it comes to data protection.<\/p>\n<p><strong>How will GDPR impact on charities? <\/strong><\/p>\n<p>I\u2019m especially concerned about the charity sector and the double opt-in issue. People (donors, fun runners, volunteers) are likely to ignore or miss requests to re-confirm consent for communications, which means the charities will lose the ability to communicate with their hard-won supporters.<\/p>\n<p>So \u2013 I urge you &#8211; if you are a charity supporter look out for emails from your chosen charities asking you to \u201copt in\u201d to continued communication so that they do not become victim to what feels to me like over-zealous regulation on the part of the EU.<\/p>\n<p><strong>What is GDPR anyway?<\/strong><\/p>\n<p>According to the ICO \u201cThe General Data Protection Regulation is a new, European-wide law that replaces the Data Protection Act 1998 in the UK.
